Joint Mandate

PayProp is duly licensed, insured and registered with the relevant state authority as a property broker, as and where necessary, and is authorized to assist property brokers in executing their direct transactional instructions. These direct transactional instructions are issued via a secure web-based interface. PayProp's involvement is limited to the processing of these transactional instructions on behalf of its direct clients.

All contractual, compliance, governance and day-to-day operations responsibility remains with PayProp's clients, which has sole responsibility for ensuring that leases and related tenancy is properly managed and that all funds are accounted for consistent with the terms of the relevant lease.

By using the PayProp platform, you acknowledge and understand that your property broker and PayProp have a contractual relationship relating to rent collection, expense settlement and security deposit administration under your Lease, and that your property broker is solely responsible for the management of your lease and your rights as a tenant.

Description of services

This tenant portal provides tenants with a gateway for paying rent and other payments to property managers and property owners. In order to provide this service to tenants, each tenant is required to register an account and select a password to access said account. It is the user's responsibility to safeguard the password to avoid unauthorized access to their account. Should the user become aware of unauthorized use of their password, they must immediately (a) change their password and (b) inform their property manager or owner. PayProp will not be held responsible for any losses relating to unauthorized use of this platform.

Users are fully responsible for all actions that they perform on the tenant portal site. This includes the veracity of payment information, bank account numbers and the issuing of payment instructions. PayProp will not be held responsible for errors or omissions by users of the portal.

Users are reminded that the lease agreements for which payments are made are in no way held or managed by PayProp. These agreements are between the relevant tenant and property manager or owner and PayProp has no involvement or liability with regard to the terms or the execution of any lease or related agreement. PayProp merely provides the platform through which property managers or owners are able to manage and execute the terms of lease agreements into which they have entered with tenants. PayProp will not be part of any lease disputes or be held liable for any losses and or legal costs associated with the lease agreements for which payment is processed through the tenant portal.

Users of the tenant portal agree that all information provided via the portal is (a) true, accurate and complete and (b) current and up to date. It is the responsibility of the user to contact their property manager should there be any discrepancies.

Users acknowledge that in order to provide this service, PayProp will be required to display personal data regarding the user on the tenant portal site. By using this service, the user agrees to the display of this data within the user's password protected access area. Users are requested to read the PayProp privacy policy to understand how we store and process personal information.

You agree that PayProp may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to PayProp, for which monetary damages would be inadequate, and you consent to PayProp obtaining any injunctive or equitable relief that PayProp deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies PayProp may have at law or in equity.

Using the tenant portal to process payments will result in you being charged a per transaction convenience fee. This fee may be adjusted from time to time and will be displayed separately to you before you approve any transaction.
